Holy crap...

Diez was driving his car off Interstate 40 at Exit 55 at about 11:24 a.m. Sunday when he saw Alan Ray Simons and his wife riding bikes up the road with Simons' 3-year-old son behind him in a bike seat, he said.

“He decided he needed to tell them he thought it was unsafe that they would do that and have their child out there in an area where they had a lot of traffic,” Splain said.
Lesson learned I'd say...read the ridiculous comments. This is why I bought a commuter bike but have been too scared to ride it.

I'm sticking with my theory on why I carry a gun. Don't want to start that debate, but I'd rather not go unarmed to a gun fight. Its already bad enough that I go unarmed to most battles of wits.

That's a good question. I was wondering if our local cycling group could protest that so I put this up on MTBR where they all hang out.

The article makes it sound like they were on the exit ramp (#55) off of I-40.
At least that is what I gathered.
Not sure about your policework there, Lou. Check the article.....He confronted the guy on Tunnel Rd. On a Sunday morning in Asheville, it's a pretty benign road. The road off of exit 55 runs into Tunnel Rd.

I mean, either way......no matter where they were, the irony is so heavy it's redonkulous.

All the road rage, anti cyclists-on-the-motorway, and carless, sleepy or drunken driver incidents... are precisely why my road bike now sits in my garage with no air pressure in the tires.

I haven't ridden it ever since the couple that were well known in the bike community were killed by a drunk lady. I saw the photos, it was horrific... all that was left were a pair of helmets, 4 mangled wheels and a bunch of shredded carbon fiber... all on a well marked bike route that EVERYONE used. A fukin shame.

The trail is safer.

I wouldn't put him on leave with pay. I'd fire his sorry ass on the spot. Public image is kind of an important thing. Let alone having a kid in a carrier on the bike, and he was put on paid leave?

What would have happened if the bullet hit the kid?

How did you determine the location? The article didn't say that the rider was on the interstate...
Diez stopped his car and confronted Simons near 1360 Tunnel Road. When Simons began to walk away, Diez shot at him, Splain said.
I am serious. A four lane road with no shoulder is a little sketchy.

I think shooting someone in the helmet is a little overkill, though. Just sideswipe 'em!

Charles Alexander Diez, 42, pleaded guilty Thursday to assault with a deadly weapon with intent to kill, but testified during his sentencing hearing that he only fired a warning shot and didn't intend to hurt Alan Ray Simons.

&#8220;I was the one who felt truly, truly threatened,&#8221; Diez told the court. &#8220;It was not my intention to shoot him.&#8221;

Complete horse sh*t. What the fvck kind of backwards logic is going on in Asheville.

Downs ruled that mitigating factors present for sentencing purposes in this case include that Diez has good character, served in the military, supports his family financially, has a positive employment history and has a good support system in the community. The judge found no aggravating factors, and Diez had no criminal record.
The guy obviously has a hair trigger. I doubt this is the last we've heard from him. Next time, he's going to re-enact Ft Hood at the LBS.

do you guys ever wonder why our society rewards people with $hitty aim?
I mean he pointed a gun to this man's head, and pulled the trigger, and the only reason the guy is alive is because he can't aim a gun.
They should reverse the sentences for attempted murder and murder.
Don't reward poor performance.
"Yeah, you shot him, but at least you killed him with a shot right between the eyes, you get 4 months.":rolleyes:

I've always thought counting attempts as lesser crimes than successes was a crock. Supposedly it's for the deterrent effect...in the seconds before completing the crime, some criminals are apparently going to self-destruct in hopes of a lesser sentence. Or at least that's the way my brother explained to me when he was in law school. I never got it.
