Not to mention the dog owner in the story's irresponsibility killed the family pet. Weird how she tries to be the victim in the whole thing, when actually she's the only one guilty.

Well since she knowingly let him out to roam free, then yes, she should pay. It's not like he got out accidentally or something.

My dogs get out sometimes. Actually the Cattle dog is awesome, I could let him out the door and he would sit on the porch all day and wait for me to get home. However Ned Flanders is a little fukker and his nose always gets the best of him and he LOVE road kill deer so he goes snooping along the road for it.

Ned is the black and white one.

when a lab goes through your grill and you're out $2k with no way to get to work, you'll go looking. If there is no leash law, it can be covered by comprehensive coverage that covers acts of god, acts of nature and does not cost the policy holder any insurance increase. It's the same as a deer, rock or tree striking the vehicle.

Now, that being said, in every case I've ever seen, liability for a dog has always been that of the owner. Leash law or no, your dog causes harm to body or property, you are liable.

We had to turn down a guy who had a $300,000 liability claim against his homeowners insurance. He got to a hotel out of town, let his 2 goofy labs out of the car and they go trotting toward the security guard as he's walking out the garage door.

Guard panics and steps over a 3 foot high retaining wall rather than back up inside. 2 stories!:(

FYI, blame this stringent response on your fellow driver. Insurance models used to indicate homeowners filed a claim once every 27 years and car owners every 11 years.

Homes are down to once every 9 and cars are at 3.:no:

I've read of serveral cases of cyclists being injured by loose dogs and the pet owner being responsible for the medical and bike replacement costs.

She's lucky the driver who killed her dog didn't sue her for emotional distress. Hitting a pet has to make one feel like crap.

no shlt they should pay, i've had dogs my whole life, they've all been better friends to me than most people and i love them to death, therefore, I don't let them roam freely. They really thought that they and there dog were so privaleged as to avoid traffic, simply because Jake liked to roam on his own?
morons, fix the car.

I wish I would have done that, then I wouldn't be driving around with a broken front bumper from that friggen dog I hit at 60mph.
