im guessing Northstar couldnt handle a "big" event?
Wait, seriously? Any half-way legit ski resort can handle ANY MTB event, if they want to that is. I'm sure there's about 5x as many people at northstar (or any big resort) on a typical ski weekend than there is people at say...Windham for their WC.

We promise you straight talk, so here it is.
It's been approximately 100 hours since Diablo posted the news that we'd terminated their lease for default, and in a deliberate attempt to create expectations and chaos, promised that Mountain Creek will honor all the 2012 Season Passes sold. Specifically the management of Diablo posted: “…..Mountain Creek resort has at least agreed to honor all 2012 season passes that have been purchased to date.”
This is an irresponsible and patently absurd statement by Diablo, so absurd that it has since been removed from the Diablo website and Facebook pages. Diablo sold you a season pass to provide services that they cannot deliver. Diablo has your money, not Mountain Creek.
Before you get up in arms, know that we're in your corner, and ultimately will resolve this so you're riding Mountain Creek in 2012. But this is a team effort, and we need your assistance. We need you to contact us. We have no roster of 2012 Diablo passholders. This will be a useful starting point in helping us to chase your 2012 Season Pass money. Please include your email for follow-up communications, mailing address and proof of purchase (please include the date). Please send this infromation to: riders@mountaincreek.com. In the meantime, you may also want to contact Diablo or their ownership directly for a refund, or contact your credit card company to stop payment or request a chargeback for your 2012 Diablo Season Pass.
Your many questions about pricing, new pass sales, events, trails, etc... will be answered in the near future. Currently we are assessing the assets, prioritize the issues and developing the game plan.
We can answer these for you right now:
No, there's no golf course going on top of the mountain
The Mountain Coaster is self-propelled and does not require the use of the Cabriolet for access
Yes, there's a killer Biergarten patio now at the new Base Lodge for after-ride brews
And Yes, where there’s beer, there's now legitimate food options
We WILL have a good time this season and provide the same world class biking you've come to expect from the Mountain.
Our primary focus is assessing the trails and getting the riding up to snuff. We’re confident that the rest will all fall in place by May 5th.

Did the Passburglar really abscond to Tahoe?

Ridemonkey has some units on the ground in that vicinity, I believe. These dudes are pretty handy with shovels.

From the sound of that post above, No. You paid one company (diablo) for a service but now that company is defunct, the new company (mountain creek bike park or whatever they will be called) is occupying the the old company's office (the mountain). The new company shouldn't be expected to honor any contracts (season passes) from the previous company, despite being in the same business and location.

::coolstorybro:: I worked in a bike shop that took over a location from another bike shop that used to have a free tune-up policy for bikes purchased from the shop. I had to tell 5-10 people per week that we couldn't honor the old store's policy because it was a different company. ::coolstorybro::

Sucks, but I would say the best thing to do for everyone who purchased a season pass is follow the instructions above to get a refund. The new ownership/management might have a whole different payment structure and pricy therefore they don't want to carry over any pricing from Diablo. Who knows, maybe you get a refund then get a season pass from the "new" park at a cheaper price.

I did contact my CC company, it seems like it is going to be a dead end.
Has anyone had luck being reimbursed?
I did send my info to Mountain Creek, so hopefully something does happen.

I am surprised that there is no talk of a class action against Diablo, or just more dialogue from disgruntled season pass buyers.

Only 60 days to file, they are still moving forward with contesting the charge.
I will let people know what does happen.
I might look into a class action although I am not an attorney.

I filed a claim about my Diablo charge with my CC company, and they have given me a "temporary credit" while they research the dispute. The money's already been refunded to my account, but this "temporary" business makes me a bit nervous. I'm not sure if the temporary money is a good sign that the dispute will be resolved in my favor or if it's just a courtesy they extend to all customers. In other words, I hope they don't invalidate my dispute and take the money back!

I have a "temporary, pending research" credit as well. i know a few others who have the money back in their account too.

I can't believe i'm jumping into this thread but...
It's incredibly hard to imagine the mountain not honoring the few hundred Diablo passes that must be out there. It would be a stupendous freaking blunder to do otherwise.

One word, Liability. Any decent lawyer for the new management company would never honor a contract from a previous business. Especially a previous business that's exiting under these sorts of conditions.

Now the mountain doesn't know who disputed it and got their money back and who didnt . So now they might be honoring passes for people who got credited from the c.c. Or ready. You know if they do end up honoring it some of the buyers won't be hononist and will show their old

i bought two oct 1st and rang the bank this week.
told them that the passes were to arrive by end of year and didn't so after not having calls to diablo returned I went to the website and saw that the business was no longer trading so please initiate a charge back.
Offered them extra info, details but they said it was fine and as long as diablo does not contest the chargeback (which means he says he is in business etc) then I get the money.
It was pending on my statement the following day.
cant see dickhead saying he is still in business and digging a bigger hole for himself so I expect the cash soon.

So Shawn should get to keep stolen money, and Mountain Creek should provide a service for free.

I am going to have to agree to disagree with you. Your logic makes absolutely no sense to me.

I have some gift certificates to a clothing store in town here that went out of business/changed owners, I will let you know how it goes when I ask the new owners to honor them for me.

Hopefully their goodwill will keep me coming back again, haha :thumb:

^ this, Why is it their problem to fix the money shawn stole? Sure the lift is spinning, but thats because passes are sold to pay for it. Do you want to pay a few extra bucks for your pass (or season pass) because mtn creek had to goodwill 200 season passes?

I can 100% assure you that there will still be a bike park there. I will be taking part in the operations of the new park. The park is built, it will need to be re-vamped and a lot of dirt work will be needed. There will be very passionate and dedicated group of people making it happen. The past is now the past and we have a very bright future on the horizon. The park is only going to get better, hard work and love for the sport will GET IT DONE!
If they really do as they say they are going to do then we all need to open our wallets and support them!!

As for the season pass holders, even if you have to pay twice you only need to ride there 10 times to break even compared to individual pass price.

I realize it sucks for the people who bought a pass but some of us pay that much in gas and hotel for only two days riding. Let's pick ourselves up dust off the dh bikes and move forward
