He wanted to know where we got our bike lights since they were the best ones that he'd seen (the Magic Shine knockoffs) so we chatted for a little bit, gave him the website since he was interested in purchasing some for their police bike group, and then we headed for home. :weee:


I can't help but think that that scenario would have been quite a bit different if we'd been driving a car....

Ha, if you were drunk on a bike, the cop probaly thought you were hobos who live under a bridge, and he did not want you stinking up his patrol car for a measley BUI.

Ordinances against public intoxication are pretty widespread though.

Here they use it to bump up their numbers. Not as much as before but they used to hang around park bars and just streamline. Apparently it's even easier than catching kids smoking weed. Good to hear it's not the same everywhere.

I was nearly charged with a DWI on roller blades while on post in the Army. I was asked to sit, remove skates, placed in the back of the car in cuffs with the skates sitting in front of the car like a vehicle pulled over.... I was taken back to the barracks in my socks, CO called, and he cussed out the fawkin' stupid MP's that called him to come in for petty bullsh*t.

I wish my CO had his sh1t that well together regarding two incidents in Pusan (ca. 1967)
  • Passed a MP 3/4 ton on a bicycle, got written up
  • Written up by a CID idiot for wearing (gasp) black Levis in the PX. At least in that instance I was able to arrange the loss of his medical and payroll records when he rotated stateside...

that also used to be a violation of DADT

That's true.

If you have one beer, you should be arrested, right?

Those ordinances are for a-holes who can't handle your liquor.

I don't think anyone near the limit should be driving either.

On a bike, though, everything is cool.

Corvallis, Oregon- a buddy of mine received a BUI in 2001. It fvcked him over just as bad as a DUI. Somehow inspired him to never Own or drive a vehicle (which I think is kinda neat) and only ride bikes.

Political? Who knows? For whatever reason there were restrictions on off-duty dress.

There was scary **** going on outside. The Doors; psych-a-delic whatever; hippies hollering that wars were not a Good Thing; mara-joo-wanna (which was at the time flowing into Pusan on Korean troop ships returning from Vietnam and of which we took full advantage). Levis, I guess, were associated with general social uproar.

In those sorts of circumstances I really have no problem with tickets being issued.

Agreed- pretty sure my buddy wasn't beeing an idiot that night- but that part could be debatable...

Boulder police arrested a cyclist early Sunday morning on suspicion of driving under the influence on a bicycle after he was involved in a collision with a car.

According to a police report, a woman in a Toyota Camry was driving northbound on 30th Street and turned left to go west on Arapahoe Avenue. She did not see Lites, who was riding in the crosswalk. The woman told police she believed the cyclist was headed south at the time. He appeared disoriented after the crash. Neither the bicycle nor the car sustained any noticeable damage, the police report said.

The report noted that it was raining at the time of the crash, and visibility was poor. The bicycle did not have any lights.

According to the police report, Lites told officers he had 10 drinks earlier in the evening. He said he was "fine" and "just wanted to walk home," the report said.

Drunken truck driver collides with drunken bicyclist near Redwood City

A drunken truck driver and a drunken bicyclist collided on Saturday night on El Camino Real near Redwood City, leaving the cyclist seriously injured, a California Highway Patrol officer said.

The driver, 40-year-old Jose Luna of Redwood City, was driving his Ford F-150 pickup truck north on El Camino Real through North Fair Oaks around 11 p.m. As he approached Berkshire Avenue to make a right turn, a bicyclist was riding against traffic in a northbound lane against the curb, CHP Officer Amelia Jack said.

The bicyclist Alejandro Chavez, 31, of Redwood City, was wearing dark clothing without a helmet or required lights, Jack said.

The truck and the bike collided, sending Chavez flying, according to Jack.

Chavez suffered major injuries and was taken to a hospital with a broken back and leg, and cuts to his head, Jack said. Luna was not injured.

A field sobriety test showed that Luna was driving under the influence, and blood work from the hospital showed Chavez was drunk as well, according to Jack.

&#8220;It&#8217;s odd for me to hear of a [drunken] bicyclist and vehicle. I haven&#8217;t heard of that situation in the five and half years I&#8217;ve been on the job,&#8221; Jack said.

Chavez, who was in stable condition as of Saturday evening, was cited for driving under the influence of alcohol while on a bicycle, San Mateo County District Attorney Steve Wagstaffe said.

Luna was arrested on suspicion of DUI and driving without a California driver&#8217;s license. He also had a prior drunken driving incident on his record, Wagstaffe said.

Luna was not charged with DUI causing injury because the bicyclist himself was drunk and riding against traffic, Wagstaffe said.

&#8220;But it doesn&#8217;t change that the driver of the car was drunk,&#8221; Wagstaffe said.

First, we loved that "OWI on a bike" quote so much we made t-shirts:



Wear at your own risk, though, since local law enforcement might not take too kindly to it.

And secondly, apparently it's *not* illegal here in WI. After talking with several of the bike-friendly politicians in Madison, I actually checked out the statutes:

346.63&#8195; Operating under influence of intoxicant or other drug.
(1)&#8194;No person may drive or operate a motor vehicle while:
(a) Under the influence of an intoxicant, a controlled substance, a controlled substance analog or any combination of an intoxicant, a controlled substance and a controlled substance analog, under the influence of any other drug to a degree which renders him or her incapable of safely driving, or under the combined influence of an intoxicant and any other drug to a degree which renders him or her incapable of safely driving; or
(am) The person has a detectable amount of a restricted controlled substance in his or her blood.
(b) The person has a prohibited alcohol concentration.

......

(2)&#8194;
(a) It is unlawful for any person to cause injury to another person by the operation of a vehicle while:
1. Under the influence of an intoxicant, a controlled substance, a controlled substance analog or any combination of an intoxicant, a controlled substance and a controlled substance analog, under the influence of any other drug to a degree which renders him or her incapable of safely driving, or under the combined influence of an intoxicant and any other drug to a degree which renders him or her incapable of safely driving; or
2. The person has a prohibited alcohol concentration.

....

(3)&#8194;In this section:
(a) "Drive" means the exercise of physical control over the speed and direction of a motor vehicle while it is in motion.
(b) "Operate" means the physical manipulation or activation of any of the controls of a motor vehicle necessary to put it in motion.
Then again I really shouldn't be that surprised since public intoxication isn't a crime here and your first OWI (driving a car) isn't even a misdemeanor... (that last one sucks, though, there are WAY too many drunks out on the roads here)

Oh, and this is the bicycle statute:

346.02 Applicability of chapter. 4) Applicability to persons riding
bicycles and motor bicycles. (a) Subject to the special provisions
applicable to bicycles, every person riding a bicycle upon a roadway or
shoulder of a highway is granted all the rights and is subject to all the
duties which this chapter grants or applies to the operator of a vehicle,
except those provisions which by their express terms apply only to motor
vehicles
or which by their very nature would have no application to
bicycles.
