"Split Pivot's lawyers argued that it should not have to pay any costs because the company was indigent and would be bankrupted if forced to pay. The court rejected that argument, saying a bankruptcy court could deal with it, if it comes to that."
At least they don't have to pay the $318,000 that Trek was originally asking for, before the judge reduced it.

Trek is going to introduce another hub standard to recoup the costs.

What happened to Weagle's legal beef with Giant a few years back? Is he 0-2?

So $40k would bankrupt split pivot? If their patents are so wonderful, valid, and valuable they should have no problem selling them to raise that kind of cash.

What would you like them to say?

Oh sure... we're rolling in cash compared to TREK, we're happy to pay any amount, especially if it's around $300K!

Ok yes bummer DW is batting 0.000, I ain't no bikgineer but in general, you sue me, then you lose, yes you should pay me legal costs. You sued me, bro! America.

The $48k for bikes used in Trek's defense though come on!!! Trek puffing up their chest there jeez.

That's one of the mechanisms that we have in place to prevent frivolous lawsuits - in certain cases, if it can cost you a shitload of money if you file a lawsuit to try and shakedown someone for money over nothing and lose.

I wonder the outcome if DW spent the same on legal fees as Trek(presuming he didn't). I won't be buying a Trek. Even if they dodged DWs patent, they still stole the idea. But did DW not steal the idea from a old design anyway? Patenting for profit holds tech back, but I can see why it's there.

This is why the judge awarded accordingly... and trek's corporate suckagge still continues. looking forward to the day special-ed buys Trek!

Pretty sure he got at least 400k out of Giant, which was well-deserved. I believe the original suit was for $1M and more may have come later. Maestro is a giant (yep) rip off DW's work which they originally intended to license but then essentially stole.

Doesn't really bother me personally (I ride one) but I do think he deserved the payout in that case - DW is the main reason those bikes work so well kinematically.

As for split pivot... maybe this would have worked better.
