Are you really that fucking obtuse? Pedro and Park are welcome to the 10nm band of spectra that covers their specific shade of blue or yellow, but I find it ludicrous that you think it is appropriate to allow a brand/person/entity a broad trademark to an entire color.

Apparently you can't/didn't read up on the articles. They can, because they have a trademark on more than one shade. That's not impossible. That's what a trademark or multiple trademarks are for. Anodizing is not always perfect.

But whatever. It's up to the court to figure it out. Not you or me.

Besides, if this douchebag at RWC doesn't want to be "confused" with Park, what's the big deal? He even stated in the article that he only has 20(?) tools left in that color. Change it then.

No, If Pedro decided he needed "a" blue tool, Big Fucking Deal.

So, what happens if a few companies "take" the remaining 7 primary colours, black, white and silver/chrome?

That would mean that NOBODY could then sell you a bike tool line of any colour, let alone a single tool that is colour coded for simple differentiation.

A choice of two tools.
One if a nice soothing Blue of middling to meh quality.
Second is a set of colour co-ordinated tools, using a different colour to indicate each tool at a glance. Quality is superior.

Which one makes more sense for a stressed busy mechanic to reach for?

My point is overbroad trademarks are BS and this is an example of that. How/why you feel the need to denigrate the owner of RWC with such vitriol? Turquoise seemed like a sensible comprise, seeing how many turquoise park tooks there are...

Try to copy one of their colors and slap your name on it. If Park has a trademark on a variance of blue, then that's it. The court will decide.

Do I work for Park? No. But find me a single shop, mechanic or home mechanic that doesn't rely on Park for good tools. Everyone on here bitches at them cause they're "Goliath". They built that company into what it is. Let them protect themselves and their assets. Like I said, we have a 5 year old running around screaming and crying and telling everybody about his problems trying to blame a bigger company. They (RWC) even post it on Facebook.

Now all of a sudden on here, Fb and everywhere else, people are claiming that Park is garbage and they're not buying anything from them anymore. Lol! Bike shops wouldn't be in business if they had to rely on other tool companies. No other company makes double sided repair stands, centering truing stands, tension meters, headset presses, cone wrenches, bottom bracket installation tools, bb removal tools, headset reamers, frame alignment tools, bb threading tools, brake pad spreaders, valve core removal tools, chain whips, cassette locking tools, cable cutters... All in one place. And at an affordable price for a shop and consumer to own.

Does Pedro's make a repair stand?

Does Abbey make a truing stand?

Does feedback make a bb tap?

I'm defending a company that makes tools that I've used for 20+years and rarely had an issue. When I did it was taken care of.

And, yes, I have a lot of Park tools, because for many tools there is no choice.

And that is my point they are asserting trademark on ALL blue not a variance which would be fine. And I am well aware that it would require a court to invalidate their broad trademark, but that doesnt mean as consumers we cant vocally and financially support companies that enage in better business practices. As Park is a longtime bike industry leader they could have resolved this in an ambicale manner and had good PR as a result, instead they chose the 'everyone else does it" bs business mantra and continue the cycle of lizard litigation stagnation. A little social media shame never hurt.

The article said that their respective lawyers had different opinions on what Pantone shades should included. It also mentioned that the initial anodized run was much closer to the "classic" Park blue, and that the other company was slowly selling their stock of this while their website was updated with as of then nonexistent other shades. Seems legit to go to court to resolve this, IMO.

I was in a bike shop the other day looking at their tools and there was a 3-way Torx tool made by Park that was Green. A lot of their other tools are black plastic with their logo sticker on it. Seems they don't really care about the blue that much and I immediately thought of this thread.
Maybe they should write themselves a 'cease and desist' letter to make them use their blue.

Park has been Blue for at least 2 decades. They trademarked it. The senior of the school politely asked the 5 year old boy to stop using it and he didn't. Park told the teacher and the teacher told the kindergarten student to stop. But he didn't. The senior then told the principal and now the 5 year old baby is kicking and screaming and spreading rumors to everyone about the senior. The senior is mature enough to just avoid the 5 year old baby and let him cry, cry, cry cause, that alone, makes him look like a jack ass.
to answer your question-no i don’t give a flying fuck what color my tools are.

Their stuff is pretty pricey considering they manufacture in Indonesia or somewhere similar.
I've a set of their hex plus and torx L keys. They are made in the Czech republic IIRC. Paid 20 Euro which is reasonable enough imo.

I can vouch for hex plus being better on the bolts, especially small ones and cheese grade hexes like the Fox 40 and 08 boxxer axles.

Agreed. Hex Plus is the real deal. Such a pleasure to work with and you notice the first moment you use them how they are just easier on the bolts.

TLDR:
The mere color rule could be applied here in favor of Park, based upon shade confusion, or for RWC due to color depletion. Current precedent would lean towards RWC when the mere color rule is used as an absolute bar;most circuits find color alone is not sufficient for tradmark.

Excellent work proving that there are lots of blue things in the world. :rolleyes: Still, I'm surprised and disappointed there is no picture of Blue Man Group.

I have no dog in this hunt, but Park is not saying they own blue for all purposes everywhere in the universe. Trademarks are registered under specific classes of goods, in specific territories. And failure to enforce a mark can weaken it. Pretty basic stuff you can learn about if desired.
