To read a patent the abstract and prefered embodiment sections are just to give a detailed example of how it can be done. These are really not useful for proving what the patent is claiming to be about but only specificially what maybe 1 tune or version can be like.

I think Trek is fine. Originally, they wanted to develop a G-Boxx bike and got information from Germany showing how to use the boxx and suspension.
Trek learned from this information about a typical 4 bar linkage, 4 pivots in rotation which 5 years later is the split pivot design.

They probably all gave up after they found out can not patent an idea that has already been shown to the public. Before DW or Trek, to promote the Gboxx, Nicolai showed off drawings of bike types using the G-boxx and one type is split pivot.
