The current dabate in canada is if the judges are too activist since the inception of the charter of rights in 1984. Pre charter (bill of rights era) they were very deferential to the legislature.
Now they are attempting to take a non interpretivist approach and redefine the meaning of some rights. Pissing off a whole lot of people, but helping keeps lame ass laws from stagnating, so it's a pretty damn good thing in my mind.
Of course it has to be balanced (section 52 of the charter in Canad) so that either insane left or right wingers can be vetoed.

really.... do people not have enough to do that they have to worry about how a term is legally defined. when we speak of anything that involves sex, you can bet some stoooopid phukker is gonna get upset cuz they get... what... a disturbing image?
why not piss off everybody and totally ban marriages? that way, no divorces... no more crying...
lastly, as a CANADIAN, i guess i can't say much about the political process of the US when my gov't is continually in some sort of silly scandal.

Well maybe not as openly fanatical.... I think that the seperation of church and state is getting blurred by some and ignored by others. There doesn't seem anyone standing up to point this out. That is the scary part to me. When by political influence certain groups can change the laws of our country/state/locality to impose their beliefs on everyone. Then there is the whole John Ashcroft influence on the Justice Dept. The Patriot Act. Man we are on some shaky moral ground right now and very few even seemed concerned with that.
So a couple of Gay folks want to say they are married. Big deal. Gods laws are Gods laws no matter what law we pass. No matter what we believe. If Gay folks get married how does this debauch the country? Live and let live I say. Equality of the Law should mean Equality no matter what you believe. Or what party you belong too.....jdcamb

hear hear. How does it affect you if they wanna get hitched? Fromt he gay couples I know, they are more devoted to each other then most "straight" couples.
As for church/state, don't even get me started. The day a book tells me how to live my life, is the day i jump off a bridge. NO offense to any religious monkeys meant, but I am pretty sure i can judge for myself what is right and wrong.

Well, hopefully, which ever Democrat faces off with Bush will hammer on these back door appointments hard. This is an issue Bush has definitely opened himself up to some serious reaction from not just the left side, but many moderates who sit in the middle. The man wants to use Federal legislation and judicial review to jam morals down our throat. Appointments such as these are just the opening salvo. And yeah, like Gay Marriages have any meaning to what most of us think are important issues.
