March 19 (Bloomberg) -- A senior member of the U.S. House’s tax-writing Ways and Means Committee from California has been taking advantage of a tax break for a home in Maryland that he claims as his principal residence.

Representative Pete Stark, the second-ranking Democrat on the Ways and Means panel, in 2007 and 2008 saved a total of $3,853 in state and Anne Arundel County taxes on a Maryland waterfront home that he claims as his primary residence, according to Maryland tax disclosures.

Stark, 77, confirmed in a telephone interview last week that he and his wife, Deborah, are registered to vote in California’s 13th congressional district using the address of her parents in San Lorenzo, about 25 miles southeast of San Francisco. Stark also said both he and his wife have California driver’s licenses.

Stark, in the telephone interview, said, “Insofar as I know, I’m obeying the law.” He said that he stays in the Maryland home about two-thirds of the year and that, “I don’t have, I don’t own another residence.” He also said he rents an apartment in his district where he stays when he is there.

How has this not made major news? This is a rich, white man that is representing a predominantly poor, black population, and he doesn't even live in the state?
2/3 of his time in Maryland, and he rents a home in the District when there?

That is insane. Seeking tax shelter from the state he represents? I can't really speak for how that district possibly could have elected a 77-yo white dude from Maryland... my guess is minorities vote in much smaller numbers.

in the military, wherever you get stationed you can then claim residency for the duration of you enlistment, even if you only had 9 weeks of training in prefered state. (relevant to this thread when you choose a no-state-tax state)

membership has its privileges, and being a MOC certainly applies here. he's working the system, and good for him. i hate paying taxes as much as the next guy.

If he and all the other non-representing representatives were actually residents of Maryland, then yeah. Otherwise, pay up. Military that live in MD but keep their HOR residency (license, voting, etc) do not get that exemption, why should they?

I hope people realize that if you live outside your district, that's a crime. There was a local politician name of Ed Jew who pulled that stunt. In jail now...

He is in jail for taking bribes, but yes, it is illegal.

maybe i should have hannity explain it to you with a finger in your chest, right after he does a setup interview w/ quanelle X on how he took katrina kickbacks from a berkeley alderman

He is in jail for taking bribes, but yes, it is illegal.
On November 18, 2008, Jew pled guilty in state court to perjury charge regarding his residency violation after accepting a plea bargain that could spare him from serving more time than what he gets in the federal case. Jew could face up to three years of jail term, which may run concurrently with the other one
