The state also couldn't take the girl unless there was imminent danger to her (see the whole Utah/Mormon thing), which the judge ruled that there wasn't. Without "imminent danger", it's almost impossible to legally take a child out of a home...
And yes, when you fire a gun at CPS, they will send in the SWAT team. Fire a gun at *any* government worker and they will send in the SWAT team.
