Because 'bro-ism' is alive and well in the cycling scene, especially from the consumers. It's the same reason Intense got away with misaligned frames and obviously miscalculated force vectors: Calling out a bike company isn't the bro thing to do, and kool-aid tastes great!

My Bro-ism is for the shop I bought the bike from, they're taking care of the warranty for me and they've taken care of me in the past. Three guys own the shop; they know me personally and vice versa its a far cry from a Best Buy size company.
I don't know Kevin nor have I ever talked to him, I dealt with Gabe when he was there and he helped me out when I needed it. I hope they have the same level of service when they have bikes available.
If I don't end up getting a frame from Evil I'm sure the shop I bought my frame from will take care of me in some way. There's no point in wasting energy threatening Evil or freaking out at shop guys since there are no frames for ANYONE. If they start getting sold before warranty frames get handed out then I'll light a molotov cocktail.
If I buy a Samsung TV from Best Buy and its a hunk of **** do I go after Samsung? No, I go to Best Buy deal with them and they deal with Samsung. Kevin replies to the shop I use I'm sure he replies to other shops inquiries. The shops are the ones with leverage against Evil since they'll be selling and promoting their bikes after this **** storm.
