Man fights citation for carrying anti-Bush sign

A southwestern Wisconsin man is fighting a civil citation for bringing a sign that read "F U G W" with him as he watched President Bush pass through Platteville last week.

Andrea Baker, an attorney for Frank Van den Bosch of Montfort, argued in a motion filed Monday in Grant County Circuit Court that Van den Bosch's sign is clearly protected under the First Amendment right to free speech.

"It's just a creeping theocratic fascism that's moving into the land here, where dissent is unpatriotic," said Van den Bosch, 53, a member of the Southwest Peace Fellowship, a social issues group.

According to the motion, Van den Bosch was standing along a street in Platteville on May 7 with his sign waiting for Bush's motorcade to pass. Bush made campaign stops in La Crosse and Prairie du Chien that day.

Police told him he couldn't display the sign. Van den Bosch then changed the sign to say "Free Us G W" and added "End the Occupation" on the back, referring to the war in Iraq.

A few minutes later, another police officer came over and ordered Van den Bosch to surrender the sign. Van den Bosch rolled up his sign and moved to the back of the crowd. He held it up as Bush went by.

Police then handcuffed him and took him to the police station, where he was photographed, fingerprinted, cited $243 for disorderly conduct and released. Van den Bosch said he hasn't paid the fine.

Platteville Police Lt. Tom Schmid said a business owner along the street had complained about the sign, and officers thought children might see it. Van den Bosch wrote the letters "r e e" and "s" in tiny print, Schmid said.

"We had to take some action," Schmid said. "If we were wrong, then the citation will be voided and taken care of that way. That's the way the system is supposed to work."

I know what ya mean, some people just got no idea. If we let this pass next will be anarchy, nuns raped in the street. This joker needs to be locked up and have the key thrown away. He is SCUM, SCUM I tell ya. Thank goodness that loyal policeman was there or god knows what might have happened. I'm going to pray now.:rolleyes:

I would like to go on record saying that this guy probably got the short end of the stick in this case.

With that said.....:)

Toshi, to bad one protestor probably doesn't require a permit to organize a mass demonstration, huh? Doesn't really qualify or fall under most limits for a permit....wouldn't you say?

FUGW is vulgar (personal opinion). Writing F ree U s G W is a d!ck way to get around what people were complaining about and ultimately not a change at all when viewed past a few feet. Why did he change it? For the cops? No way....he did it to piss off the cops. ;) But he is sooooo smart....free speach and all. Wasn't enough of a change for the cop (now flexing his muscles) so he asked for the sign. The guy went to the back of the group and waited until the moment that it counted and threw the sign up...all the while acting like he had given up and was content on watching.

They arrested him for dissorderly conduct. A charge he might definately be guilty of (though this article is not detailed enough to assess that) and that is not protected under Free Speach.

People are tazed for less. :)

I find it funny he is a member of the "Southwest Peace Fellowship", a social issues group. With a sign that says "F U G W"......how "peacefull":D

Not once did I say it was outlawed. :confused: I gave my opinion. What is to decifer? :rolleyes: I was upfront about how I felt about it....exactly what part of

Yet you bring up the permit issue (not relavent to this event) like it was relavent.....

I am saying he was cited for "dissorderly conduct." That is not protected under Free Speach....or do you feel you can do anything in the name of free speach? :think: I am saying, from the article, there is no read on how the protestor acted. No indication whether it warranted a citation or not. The charge it self will be weighed in court and either upheld or dropped. That is an issue between the cop and the protestor that the courts need to figure out.

This is even less a freespeach issue than most other examples given in this forum.

And once again for those who missed it:

I think the right to speak out against the government is the very principle that the Freedom of Speech Act was founded on. Am I wrong?

Isn't it the right to speak without government making law to curtail that right with their power?

Before anyone gets their panty's in a bunch.....;)

It however, does not negate other laws one might break in practicing their right to free speach.
You can't trespass (break the law) in the name of free speach. You can't hit people over the head with beer bottles in the name of free speach.
You can't be drunk and/or dissorderly in public in the name of free speach.
.....you cannot break laws and expect to use free speach as a get out of jail free card.

I think many people who are cautious about other people who claim protection under free speach are that way because they see it abused to justify actions that would otherwise be illegal. But that comes with our society these days I guess.

I seem to remember free speech having something to do with being able to speak out if you disagree with your government without being punished. Wasnt that one of the reasons the US was formed, werent they revolting agains a gov that wouldnt let them think, believe, or do as they wanted?

I guess when someone is brandishing a deadly sign its ok to squash his right to free speech :rolleyes:
