He'd likely be on the hook for his modification, but if it could be shown that these suffer from a defect and Fox is not conducting a recall, hell even if they are, they could be wide open for litigation. Someone could easily sue Fox over his vegetable state, showing the product was defective and that they were not acknowledging this. I am pretty happy with SKF seals on my 36. After 3 months of riding, bath oil was still pretty clean. Fox used to build dampers geared for mountainbiking, not specifically for consumers just so they wouldn't get confused. And that so happens to still be the best configuration they ever made. I change my damping settings depending on what I'm riding (and sometimes just based on how tired I expect to get).....sometimes pretty drastically.
It has nothing to do just going fast. It's versatility sacrificed for the lowest common denominator because it's a product before it's a suspension component.
