I would guess caliper alignment is your problem, if you haven't already exhausted that as the possibility.

If the brake wasn't rubbing before, with the same wheel, fork, and brake, something has changed that should now by made to work again.

There are two bolts holding the caliper on. Loosen slightly and you can slide the caliper around. If you apply the brake with the bolts loose, the caliper should self-center. Sometimes you need to adjust from this position a hair,

Next thing to look for, in my opinion, is a piston seal in the caliper. If one is bad, it may not be retracting fully after brake application, leading to rub.

thanks for the help, it turns out the rotor is not circular anymore. it looks like an ellipse. and it is bent to the side, have to replace it

Elliptical rotors are the latest in world cup stopping technology.
Not really the latest. Remember Biopace rotors?

And fer chrissake, I didn't even think to ask if the rotor was straight, because that's like a guy asking why his car won't start and telling him to check if it has an engine.
