In a stealth maneuver, President Bush has signed into law a provision which, according to Senator Patrick Leahy (D-Vermont), will actually encourage the President to declare federal martial law (1). It does so by revising the Insurrection Act, a set of laws that limits the President's ability to deploy troops within the United States. The Insurrection Act (10 U.S.C.331 -335) has historically, along with the Posse Comitatus Act (18 U.S.C.1385), helped to enforce strict prohibitions on military involvement in domestic law enforcement. With one cloaked swipe of his pen, Bush is seeking to undo those prohibitions.

Public Law 109-364, or the "John Warner Defense Authorization Act of 2007" (H.R.5122) (2), which was signed by the commander in chief on October 17th, 2006, in a private Oval Office ceremony, allows the President to declare a "public emergency" and station troops anywhere in America and take control of state-based National Guard units without the consent of the governor or local authorities, in order to "suppress public disorder."

Two reasons to not be concerned:

1. So many Americans are already armed to the teeth, some have weapons, body armor and hardware that's superior to the National Guard.

3. You can't subdue a population without brainwashing the military. No way will they kill regular people. At least not their people. Iraqis are a different story.

Havent you grown tired of being laughed at for crap like this? Bush might hate queers and like big oil, but ****ing relax. Put down the pipe, and relax. This isnt the new world order.

Easy now Shirl. The fact is that Bush has signed legislation that, if he wanted, would allow him to effectively become a 'dictator' in the US. I'm just pointing out to you that this legislation exists. I doubt he'll ever get the chance to use it (fortunately for you), but as always I am slightly surprised that the media as a whole seem to be ignoring 'technical' stories like this these days.

BTW SF Indymedia isn't the only place covering this, they just happened to be top of the Google News list.

Loved that donkey pic too! We shouldn't be to hasty calling it 1984 though, he still has 26 more months to rule so we'll get there. But I'm not sure most people will now what time it is when the clock hits...

Former 'enemy combatant' claims torture
MIAMI, Oct. 31 (UPI) -- Terrorism suspect Jose Padilla, originally held as an enemy combatant, has asked a federal judge in Miami to drop charges against him because he was tortured.
Padilla's lawyers say that he was kept from sleeping, kept in shackles for hours and housed in a small cell at a Navy brig in South Carolina. They also allege that interrogators threatened to cut him and pour alcohol on the cuts and gave him drugs, possibly LSD or PCP.
U.S. District Judge Marcia Cooke told federal prosecutors to respond to the torture claims by Nov. 13.
Padilla, a U.S. citizen, was arrested in the United States in 2002. The government originally claimed that he was an al-Qaida operative and planned to set off a dirty radioactive bomb in the United States.
He was charged with conspiracy last year and moved to civilian custody in January.
Cooke has already dismissed the most serious charge against Padilla and his two co-defendants.

Rick, have you ever heard of the Cuban Five? They were arrested in 1998 after they had joined exile Cuban terrorist groups in Miami to expose their actions. They furthered the information they got to the Cuban government, who in turn took the matters up with the US government.

The trial was a fars, and the National Lawyers Guild, among others, have spoken out against it.

I had not. I'm not sure what this has to do with this thread, other than highlighting the kangaroo courts we have in the US. If you want to know about that you should read about some of the US income tax cases. Irwin Schiff (http://www.paynoincometax.com) was convicted and is in prison right now. He was prohibited from entering the US Tax Code into evidence at his trial. That is correct... Irwin could not use the text of the law he was accused of violating as evidence in his defense.

I guess this new law (Military Commisions Act) just keeps the US from having to embarass itself any longer. Being able to convict based on secret evidence and just doing whatever the funk they want sure makes things a whole lot easier.
