It seems from the limited info that the border patrol agents were the only ones doing the shooting and they're instructed to not pursue illegals.

Seems like an open and shut case.

If you can't follow the rules, you shouldn't be enforcing them.

Yeah, they sound bad, but the intent of my original post (Didnt say it, oops...) was that these guys (BP as a whole) are not allowed to pursue, that is stupid. Why bother putting them out there then? And that they engaged an armed felon who illegally entered the country to do bad stuff, who was armed, and showed hostile intent. Now, he was treated at a US hospital (Paid for by you, the taxpayer!) and they are going to jail (Paid for by you, the taxpayer!). And he is still free, and possibly still crossing the border to do more bad stuff. Where are the Minutemen when you need them? Or a tall tree and a short rope?

I agree, but the article wasn't clear. Are they allowed to pursue while the illegal is in the USA? Maybe the instructions are to not cross the border? It's unclear.

Well, the truth is, that article didn't say he was armed. The BP thought they saw something that looked like a gun, but that excuse is scary. The article clearly omitted any comment that the illegal fired on the BP. Just that, vaguely, shots were fired.

The minutemen are a joke. And "a tall tree and a short rope?" Come on, we are not talking about Saddam :hmm: . Besides, if the border patrol was to start using more "force" against drug traffickers...the border region would turn into an all out war-zone, even more so than it is. You can't even begin to imagine the power these guys have (cartels) south of the border as well as here in the good 'ol USA.

With that said, I believe that this is a very tough decision to make. Should the agents be pardoned? Morally, Yes. They were doing their best to protect the country. As mentioned however, they broke the regulations imposed by their own organization...so it would seem that they are entitled to some sort of punishment. The sentence does seem rather harsh in my opinion. (Yeah the article is kind of vague)

i agree with alf. wouldnt 1 or 2 years each have been enough? or even just a suspension? it also seems to me that the BP really needs to go over their procedures on engaging aliens because if you cant pursue a criminal how are you supposed to catch them?

What if it was a gun the dude had and had shot and killed one of the BP guys? Then the other one would have to live with the fact that he could have saved his partner's life. I know from something similar, it's better to take the shot. And the BP definately needs to look over their regs again.

Well, the BP has rules. If the agents don't like the rules, they should change them, failing that, agree to follow the rules or find another job.

Yes, the punishment is extreme to the absurd. The guy they shot didn't die, right? He continuted running away?

Seems like they should be fired without benefits or unemployment compensation would be fair? It's not like they shot at the guy 50 times or tasered him to stupidity.

If the guy was unarmed and running away, it seems to me he did not pose a threat to the agents life so shooting him under those circumstances looks to me to be borderline attempted murder. :disgust1:

But that said, without being there to witness EVERYTHING that happened that day, or to hear all that was said in court. I don't think one can come to a fair and just verdict on the case. *shrugs*:clue:

Well said DW, everyone should remember that the next time some cop pounds, shoots, tasers, asps, pepper sprays, or whatevers some stupid (add group here) into submission and we end up with a bazillion page thread of sniping between the internet lawyers clubs...
