Also...since the definition of a "sweepstakes" you posted explicitly states no payment is necessary to enter....and for this contest you must donate at least $5...isn't this not a sweepstakes? More of a general raffle than anything.

Still applies, the actual wording is "A purchase, payment or donation is, or seems to be, required, to enter the contest". Similar to this contest, Easton raffles off bikes for charity which have a clearly stated means of entering other than purchase/payment/donation for legal compliance:
