12-Year-Old Faces Murder, Rape Charges

SPRINGFIELD, Mass. (AP) - A 12-year-old boy has been charged with murdering and raping a male preschooler, a prosecutor said Tuesday.

The 12-year-old is not being identified because of his age. He is scheduled to be arraigned Wednesday in juvenile court.

District Attorney William Bennett said 3-year-old Jeremy Rosario Milan died on Dec. 19, two days after being hospitalized with bruises and a head injury.

An autopsy found the younger boy died from blunt-force trauma to the brain. Bennett said Jeremy had been raped at least twice and beaten several times between Dec. 11 and Dec. 17, while he was left in the care of individuals outside his immediate family.

Earlier, the 12-year-old was charged with assaulting the little boy and pleaded innocent in juvenile court. He has been held in state custody since then on $10,000 bail.

Alan Black, the 12-year-old's lawyer, declined to comment.

Under state law, juveniles convicted of murder can be held in state custody only until age 21.

How absolutely nauseating. A 3-year old subjected to THAT by a kid that has somehow already been transformed into a sociopathic monster. I can hardly wait for him to be released back into public. A good, productive life is sure to follow. :(

Sadly, I really believe that some crimes are so bad that once committed- regardless of age- the very capacity to carry them out should forfeit one's right to exist. Most likely, the 12-year old has suffered terrible abuse and living conditions beyond his control...but no matter what, if you end up even through no fault of your own that twisted a soul, you need not live among others. I wish I didn't feel that way.

I'm not a psychologist and I don't know the details of the case, but it's hard to imagine someone capable of something like that at such a young age ever being able to function as a member of society. Without knowing why he pled not-guilty (you never know what circumstances and information are ommitted by the media) it's not fair to judge, but I can't help reading that and picturing a ****ed up little kid who isn't sorry enough to even admit he was wrong. Everything about this story is mortifying.

Who'd the parents leave him with, and why did those people let the 12 year old kid brutalize the 2 year old?

Seems like there's a bit of blame to go around here...

There's a 12 year old kid that shouldn't see his 13th birthday. Or maybe 75 years in a cell would give him some time to think. It's pretty hard to feel sorry for him at all. That sounds like an psychopathic adult crime to me, and that degree of psychopathology is not really curable.

some people are just programed wrong. who's to say that this kid couldn't have been the next great serial killer and was just caught too soon? (or late, whatever...)

No one else is wondering who was supposed to be watching the 3 year old for the week?

Someone else better be up for depraved indifference too at some point, barring some pretty ****ing huge extenuating circumstances (like a coma, perhaps...)
