I think that's probably legal, but maybe a bit overly aggressive?
I watched it live. There was not much in the way of "good race, bro" high fives and congratulations for him after the race. A lot of other racers were pretty clearly pissed about how he handled that pass. I have a feeling come next season (or next race even), he's going to find himself the recipient of a lot of "overly aggressive" passes.

That race was last weekend in Vegas, the Finals. Fined 7500 a few days ago. Rumor is the 250cc Title was 500k - so what would he care?

450 had drama also; John Tomac's son Eli rode to 2nd overall. Seemed the better racer in the end however.

From a $ perspective? Not at all. From the sponsor and future race perspective? Probably has some factor. If people know you have no concerns about taking them out for a pass, then they will give you no concern when that situation come up. As for a sponsor, that shows a lot about how you handle things. If you're an asshole, that gets associated to the company to some extent.
