If all storms had a name, this one would start with the letter F.

As Tropical Storm Edouard closed in on the Texas Gulf Coast last week, a storm of a different kind was brewing inside the sporting goods section of a Wal-Mart store in La Marque. It started with the F-word.

And now a 28-year-old single mother must go to court if she wants to fight a ticket for using profanity.

On Aug. 4, as local residents prepared for deteriorating weather conditions, Kathryn "Kristi" Fridge made a last-minute stop at the Wal-Mart at FM 1764 and Interstate 45 with her mother and 2-year-old daughter.

Finding the batteries shelf bare, she expressed her displeasure and disbelief to her mother.

"I was like, 'Dang.' I looked at my mom and said, 'They're all ----ing gone," Fridge recalled.

Suddenly, Capt. Alfred Decker, the La Marque assistant fire marshal, appeared from around the corner, dressed in a fire department uniform.

"He said, 'You need to watch your mouth,' " Fridge said.

Perplexed by who the man was — his badge said "fire department" — Fridge offered a scant apology.

"I was like, 'Oh, OK. Sorry?' " she said.

Fridge walked away, but said the man ordered her to come back. She then protested, telling him she was having a private conversation with her mother that was none of his business. When the man ordered her to come to him and she refused, she said he pulled out his handcuffs.

Enjoy the new American™ way of life. Where freedom of speech is not accepted by even a mother****ing assistant fire marshall. Oh the power is going to their heads alright. And even saying you're ****ing sorry isn't good enough anymore.

Who gives a **** that there is a god damned tropical storm bearing down on you, you had better watch your ****ing mouth.

The police chief should be cited for using the word "cuss" as an explanation of her law-breaking.

It will get overturned, it doesn't present a danger to the community.
not if it was in my city....or any of the municipalities within a 50 mile radius.

most city's in my region have city ordinances that make it an arrestable offense to curse in public. Yes, there is freedom of speech but if it is considered offensive to the "general public" then it can be curtailed via law.
i think the fire marshall went a little out of his way to prove his point but the ordinance does serve a purpose, especially in crowd control situations.

How do you define general public? If I found a public figure I disliked, could I form a group of people and say we found his speeches offensive? I'm not knocking you, I just think an ordinance like that is stupid.

If you buy a lift ticket at a resort, there is a bunch of legalese on the back that claims to absolve the company of any wrongdoing, up to and including marching 6 million Jews into a gas chamber. That doesn't mean it will hold up in a court. Where am I going with this?

...just because a law or ordinance or clause in a contract is written down doesn't make it constitutional.

Yes manimal in a crowd control situation that bylaw can be very nessesary do help with pulling out troublemakers in order to diffuse a situation.
BUT!!
That scene in the shop was utterly uncalled for. He was an assistant fire marshal NOT a cop and that is a big difference in the level of experience/knowledge when it comes to crowd control/dealing with the public. Guy sounds like a right dick with a power control problem.

hah..got to add Walmarts name into the story...it's increases the drama...even though they had nothing to do with what happened...D
