I'm all for due process, humanitarian treatment of prisoners, detainment ONLY with strong cause, but I hate technicalities. If the guy committed the crime, the he needs to be charged.

Well, there must be a crime to answer, which is a technicality.

I agree with Fluff. Killing a US medic with a grenade is not an arrestable 'crime'. Instead of shipping the little Queeb to guantanamo we should have had him dig his own grave, shot him in the face and accurately labelled him a 'dead enemy combatant'.

Which country do you take him from?

The whole scenario is ridiculous; you invade a country then attempt to charge the people you fought against as if there was no invasion. If you start a war you must surely expect some opposition, otherwise why take guns?

The point isn't that opposition is somehow a surprise, but labeling the captured combatants properly.

If they're not POWs, then by default, they're "illegal" combatants. If they're POWs, then treat them as per the Geneve convention.
