Screwed on ebay

So I bought an 03 Rocky Mountain switch on ebay:

It came in today, with a crack on each side of the shock mounts on the front triangle.
Can this be fixed or would it be a waste of time? Seller will give me full refund minus my shipping cost, or money off the price to be worked out between us.
I only paid $800 and if I could get a couple hundred back, it may be worth it.

Any opinions?

Rocky mountain said they would not warranty it, there is a one year warranty only. My local bike shop would know I did not get it from them so I am kind of stuck.

send it back and get the TOTAL cost to you refunded...screw that minus shipping crap...you're not the one that sent a cracked frame....D
 
i bought this last summer, had 4 cracks around the headtube..... it also came witha super t with gouged stanchions, bent rims and rotors, and rusted-on crank arms........

my wife is in law school so we had her make an "official" document that we would continue to follow with charges if we didn't agree to return each others merchandise. the bikes condition was clearly mis-represented and out of focus pics to boot.....
we got our money back.....

If you don't get your money back plus all shipping involved - I'd contact Ebays fraud dept. That's BS. Whatever the outcome, be sure to leave negative feedback so others will be aware that this guy is a jerkoff.

Full refund? Its got great parts (i.e., Hayes, decent wheels, good fork, decent drivetrain).... I'd take the offer for a full refund or at least minus the cost of the exact same frame that sells on Ebay. You'll end up paying more to send it back (shipped twice). I'd sell the good parts on the frame (rear triangle, bolts, etc).

Some ideas. :)

Did you really suggest warrantying the bike??? You'd be a shmuck to warranty a bike you bought that was cracked; just not cool. Warranties are for the original owner, that's part of what you get when you buy a new bike from an authorized dealer.

It sounds like the guy who sold you the bike is suprisingly cool about it, I'd jump on the chance to get my money back in full. Or, as someone said, if you like the parts spec work something out to send back just the frame.

send it back, get all your money back, OR get one he11 of a refund for it, you are the one that should be setting the terms because it was you who didnt get what you paid for.
i agree with the others, no refund-minus-shipping or warranty on this one. you shouldnt need to do any work, this guy is a player and knows whats fair he`s just trying to get the better of you if he is tells you refund minus shipping.

don't just say that it's not as it was described. say that it's defective, dangerous and unrideable. get an email from rocky saying that it's unrideable, and demand your money back plus shipping BOTH WAYS. threaten to leave him horrible feedback (he's 99.9% good, so that'll kill his rating), threaten to go to ebay with your complaint, etc. OR, ask rocky what a crash replacement would be, then deduct that from the 800 (or 900) that you paid. pretty smoking deal, and if you could get a (free for you) crash replacement, that should be pretty good.

just some thoughts.

Rocky does not offer a crash replacement, nor do they sell just the front triangle, I will certainly bear this in mind for future purchases. I think I may stick with Santa Cruz, as their warranty department hooked me up with a crash replacement on my bullit swingarm even though it was about three years old, well out of warranty and I was the second owner.

one negative will do almost nothing to his feedback...I'm suprised he even bought from the seller...I took a look at his fedback and he has a ton of feedback withdrawals and neutrals...all about the same thing...slow shipping and items damaged upon arrival...99.9% can offer a false sense of security one should always take a look to be sure because neutrals don't affect overall ratings....D

No, I don't have any info that would suggest he is or is not. I'm just thinking aloud. If the guy does read the message board though, he's probably going to be pretty cool about getting this straightened out. On the other hand, anybody who advertises broken junk as useable gear probably isn't the type of guy who's willing to work with you.

it looks like the guy sells a lot of stuff but that doesnt mean he is able to spot a broken frame even if his ebay rep depended on that, the interesting thing is how he handles himself AFTER the buyer breaks the news to him that the frame is useless. this has happened to me before a couple of times, with wildly different results.

I wouldn't buy bikes from high volume auctioning companies or similar high volume warehouse dealers like what Smedford went through. They may have good feedback for fast shipping, etc, or whatever floats their boat. The bottom line is that they may not know much about the product(s) they are selling, and all they could give you is pictures and the names of the parts on it (i.e., Hayes, but I could assure you that they won't know what type of Hayes brake it is - i.e., HFX, purples, etc). :rolleyes: I usually buy my equipment used via people who have a rep for selling bike parts since it will be a higher likelihood that they have an idea of what they are doing. If possible, I like to work with locals to pick up parts simply because I can hear it :nopity: , see it
, touch it :eek: , and :drool: over it. Just common sense.

They are actually being pretty cool. They had me take it to my local bike shop, and they are paying them for shipping, then when they get the bike back, they will refund my money in full.

It is true what has been said they did not know about the bike. They are not bike people.

Lesson learned.
