Seeing ebay advice from you monkies!

The winner of the auction refuses to pay up. Here's the story.

The guy emailed me about a day before the auction ended, and asked me to cancel his bid because he thought it included the shock. I was going to do it, but then I asked him why he didn't do it himself.. I wasn't quite sure how to cancel his bid. He replies back with it being too long, and not letting him. I was fine with that, but the next comment sort of set me off (I'll admit, I was in a bad mood and I should have just found out how to cancel the bid to save me some trouble) - he told me that the picture was deceiving because it had the fork in it. Okay, I understand his point, but I didn't have a very long item description. I listed the parts that were going with the auction, and then listed at the bottom that the fork and wheel weren't a part of it.

He ended up winning, and his emails went on to say that it was falsely advertised, that I wasn't truthful, I was a scam artist, etc etc. Prior to his 2nd email to me, I had checked out his email and saw a negative feedback. This has been on going, with him refusing to recognize that I didn't advertise it falsely. Heck, am I supposed to list that those boots and boxes aren't included in the auction too? I've never had to deal with this before, but I won't be making the mistake of using a picture like that again for a similar auction. It just so happened that I had lent the digital camera to a friend, and we HAD to get rid of this frame, so up it went, with the best picture I could find.

He's told me to call him, implying that he was just going to try and reason this with me (about how I'm wrong). I replied saying that I don't have the time to deal with that, if you didn't read the item description, it should be your fault, and you should follow through with the auction. He ended up requesting my information from ebay, and called me.

His attitude over the phone was horrible. Straight on the offensive side, and it didn't make me feel like I wanted to deal with him any further. I told him to give me his shipping address and method of payment, or I'll just report him to ebay. He started up again, and I said, that's enough. Do it, and that's all I have to say, and hung up. The guy proceeded to call me back numerous times, and even left me 3 pleasant voicemails, which I've uploaded below.

I've also received 2 emails from ebay, one titled: Urgent fraud prevention group notice, and the other titled: TKO Notice: Urgent Safeharbor Department Notice. Is that his doing? I'm not quite sure what to do here.

If this guy happens to be on RM, that's fine. I'm not afraid of anything, I don't think I did anything that was totally wrong. Judgin by his tone and his method of speech, I'd say he's either young or really immature. Threatening to pay me a visit? Kind of childish.. how should I go about handling this?

For my standards, I haven't been polite with him. But not once have I uttered a single cuss word, or called him anything. The emails told me not to reply to them though.. I live close to ebay hq. Should I just head over there in person?

Great move saving those messages...He basically screwed himself over when he threatened you. Just use the dispute resolution service that Ebay has for sellers who have buyers like this guy. Also, in extreme circumstances like this, Ebay CAN remove any bad feedback this guy gives you, so I wouldn't worry about that.

If that doesn't work, I would contact ebay directly.

Yeah, like Zack said, good move saving those messages. With that kind of evidence, he just lost any claim he would have had against you. Looking at the auction, its very clear what it does and doesn't include, and its obivious you were not looking to scam anyone. Good luck on this.

He sounds like hes in high school. His word choice blows as well...if he wanted to threaten you, why couldn't he do it with style?

wow any dip**** with half a brain could for sure figure out what was and wasnt included in the auction by actually reading the description. whats his ebay user id so i can make sure not to do any business with him in the future.

so he's going to pay you a visit huh? the thing that freaks people like him out is if you stay calm and tell him what will happen if he does. No threats. no promises, just the truth.

If a buyer retracts a bid it shows up on his/her feedback for 6 months. Ebay states...Abuse of this feature may results in the suspension of the account. Bids retracted within the last 24 hours of listing can be viewed as bid shielding, which is a serious violation of our policy. If you cancel his bid it won't show on his feedback.

The 2 emails you received from ebay are his doing. He's basically filed a fraud claim to weasel out of paying you and to protect his feedback rating. You may want to respond to these messages as too many complaints against a seller gets you in the dog house with ebay. If you remain silent and they decide to side with him it may cost you $ (listing fees). I do know as a seller you can file a claim for a deadbeat buyer to recoop your listing costs. Also there is a process you can envoke to sell the item to the next highest bidder without having to relist the frame.

I wouldn't bother with leaving bad feedback. He'll just do the same with some lame reason and and you'll both have a bad mark on your feedback rating.

Keep in mind that there is a timetable you must follow if you would like to take advantage of some of the "features" that ebay allows (like filing the non paying bidder or selling to the next highest bidder). There is a lot of stuff in ebay's help section if you need more clarification.

Well I'm guessing the userid that won the aution is the one in question. The second thing I noticed is he purchased a bike on ebay on the 18th. That maybe why he didn't want yours. Your auction is Clear as Day, and I think you need to follow up with ebay. Even though they really can't do much in my eyes. If he kept harassing me with messages like that I'd file a report, just to have it documented. If he doesn't bother you, ask him what day he's going to be in town and you'll pick him up from the airport. That way he can get his ars beating over with right away. I'm getting so tired of ebay, and the idiots it attracts. If you don't do anything, at least clear everything up with your account. Maybe they will at least let you relist it for free.

I think you're in the clear, because you wrote that the fork and wheel were not part of the deal. It is his fault for not reading the description properly. He does have a small point that the photo showed the fork and wheel, but I really don't think it's enough for him to stand on.

Go to ebay and file your own "bad buyer" report. They will take care of it. If you don't want to deal with him, let ebay know that you want to re-post the auction.

I agree. The photo may cause some confusion, but it is his fault for not reading your description.

Cool, thanks for the words guys. I know about that pic, usually I don't do it.. but in this case we just wanted to get that thing out of my friend's garage. I'll wait patiently next time, if I really wanted to attempt a scam I would have written a huge description so the bidders don't want to read ;)

Will the PD really do anything about it? There are some wackos out there, not really intimidated by this dude, but if he happens to find my addy :rolleyes: He's more than welcome to kick my butt, but he can choose to deal with the cops or another huge group of guys - I doubt he'd be comin out here with a plane full of people :eviltongu

I think I may just leave him be. Might be more simple to just leave him unprovoked and let ebay handle it all.
