Mavic is usually way happier going through a shop than dealing with customers one on one. If you can go to the shop you bought them from you should be fine.
I've been going to the shop where I bought them for 10 years. I'd hope they'd cover me. We'll see. If not I'm going to try to secure that strap somehow. I don't want to have to buy new shoes this soon.
If Mavic or your LBS can't/won't warranty it, take it over to a local shoe repair. My local shoe/leather repair place has done wonders on my work boots.
With few exceptions, most consumer goods now-a-days are crap and are made to wear out prematurely. Because as a society we are happy to buy another. Sad.
One shoe exception is Danner boots. I have the same pair for over 10 years.

JUst as I was actually getting pumped to do my rivet/webbing fix I find out that the LBS is going to warrantee them for me. They also are possibly going to swing me a hell of a deal on a 2011 Specialized Camber 29er.

My temporary fix while I wait for new shoes to arrive. Punched 2 holes all the way through the shoe and secured the loose side of the buckle with a ziptie... that should hold for a week or 2.
