In April of 2005, Jeremy Robbins was arrested attempting to traffic two tons of marijuana from Arizona to East Tennessee. Indicted on federal drug conspiracy charges, Robbins was soon assessed a $1.1 million fine from Tennessee's Department of Revenue.
And do you know why?

The reason: failure to comply with the state's Unauthorized Substances Tax, which requires anyone in possession of a certain quantity of contraband — in the case of marijuana, more than 42.5 grams — to buy a tax stamp from the state government and affix it on the drug.

So wait, if you have something you arent supposed to have, you must report it to the government in order that they may impose a tax and then issue a stamp for said contraband item?
Makes perfect sense to me. In a f*cked up, backwoods kind of way. Isnt Ashley Blue from Tennesee?

Pass laws requiring taxes on prohibited substances. That way when the dealers go and buy the tax stamps, the police know who is holding. If you don't buy the stamp, then there is another charge they can convict you on.

It is an American Classic. They got Al Capone on tax evasion, you know.

That is how many drugs were made illegal in the first place. Require a tax stamp but never issue the stamp. Most states work(ed) like that.

What is the difference if you call it a "tax" or a "fine" ? You pay them both in US dollars.

a fine is imposed as a penalty for doing something wrong.

a tax is imposed for any number of reasons, but it is not for doing something wrong. non payment of taxes may be a crime in itself.
I mean you can look at it however you want, but in reality you're just having to pay because you have an illegal drug. Call it a tax, a fine, a debt, a bill, a punishment...it's all semantics. You guys are getting pissed over the wording when the real issue is with whether it should even be an offense. Not that that argument will ever go anywhere, Im just saying it's sort of a pointless debate.
