I just call some BS on his "loud and boisterous" arrest for a silent protest (not the usmc's doing) and the issue with him wearing his uniform (it had the nametapes and USMC paraphenalia removed, so it was the same thing anyone could buy at a surplus store).

Technically, I think the USMC is right, and Kokesh can be processed this way, but I've seen Marines who've done really bad/stupid crap still receive honorable discharges. And in the end, all the government is doing by squeezing Kokesh is getting him more publicity and making themselves out to be enormous douches...which is sort of his point anyhow...so maybe he wins in the end, because his discharge class won't really change much in his life, and will probably earn him a million more when he sells his book down the road.

I'm not sure of the legal status of IRR members...I didn't think they fell under the Uniform Code of Military Justice unless activated, but I never really bothered to check...either way, they have a hard-on for this guy.
I would've sworn that I was told that I was only subject to UCMJ under IRR status if I was called back to active duty or during any muster duty to complete annual screening. And then I was not subject to UCMJ until I actually reported. The only caveat I remember was that the change in status didn't keep them from charging me with something done while on active duty. But in that case they would recall me, then proceed.

Sounds fishy that they can get him for wearing BDUs with the patches stripped.

Yeah, my point was that he was being processed for his disrespect to a major who admonished him about the wearing of his uniform during the protests, not for protesting per se. I'm sure his lawyers will have his subjection to the UCMJ at all right up front...it should be legally clear sailing.

If his discharge does become less-than-honorable (stop snickering), he could always civilly sue the USMC for damages and possibly win and/or get it to the Supreme Court. I would be concerned, however, with what the current SCOTUS would rule on such a case...

Funny thing is that Marines don't wear BDUs. They wear utility uniforms, you dogfaces.

IRR is a total sham. It used to be the LAST called and now they are being activated left and right.

Funny how the military likes to promote that they are meeting and/or exceeding recruiting goals, yet they are still having to call IRR folks that have been out for 2 and 3 years (or more in some cases).

It could be a Marine-specific thing, or a recent revision in the name...but it is individual now; I left it about a year ago.

It's included among the mandatory gothic-letter tattoos these days, just so we can remember how to spell it.

I'm also shocked that the army actually says "B-D-U" instead of trying to pronounce it, like they do with everything else. I went to the Army's cav school, and they were talking about "Bimps, Berdims, and Beaters," which confused the hell out of me until I realized they meant BMPs, BRDMs, and BTRs. (Those are Russian venerial diseases, VB.)
