Regardless of intent/reason, you can't shoot the jays, it's a federal crime to harm or kill the birds without a depredation permit. You also cannot disturb or harass them in a non-harmful way during the breeding season:

We has mocking birds nesting between two apparent buildings that would raise holly hell early in the morning. My neighbor, the bus driver from South Park, would yell out the window at the top of her lungs, "shut up bird, shut up" and her boyfriend joining in with some "woo, woos". Seriously this woman looked and sounded just like Mrs. Crabtree.
