Women Sue Wal-Mart Over Contraception

Backed by abortion rights groups, three Massachusetts women sued Wal-Mart on Wednesday, accusing the retail giant of violating a state regulation by failing to stock emergency contraception pills in its pharmacies.

The lawsuit, filed in state court, seeks to force the company to carry the morning-after pill in its 44 Wal-Marts and four Sam Club stores in Massachusetts.

The plaintiffs argued that state policy requires pharmacies to provide all "commonly prescribed medicines."

Wal-Mart carries the morning-after pill in Illinois only, where it is required under state law, said Dan Fogleman, a spokesman for Bentonville, Ark.-based Wal-Mart.

Fogleman said the company "chooses not to carry many products for business reasons." He would not elaborate. But in a letter to a lawyer for the plaintiffs, a Wal-Mart attorney said the store chain does not regard the drug as "commonly prescribed."

CVS, the state's largest pharmacy chain, stocks the pill at all of its drugstores.

It's possible that Wal-Mart refuses to carry the medicine for ethical reasons (as some stores do--I saw a 60 Minutes program on this) but it's also possible they chose not to for business reasons. If too few people chose to have their emergency contraception perscriptions filled at Wal Mart, then they a) may not make their money back and b) may risk offending millions of other customers just to provide a perscription for a few people. I'm sure I'm missing other equally important points here too, but that's what I take from it.

It's not a stores right when it comes to medications, apparently. (Public health issue I would guess.) Personally I think a stores owner should be able to decide what to carry and who to hire.

I also agree with Transcend. As unpopular an opinion as it is, I feel that we should excercise personal responsibility. And yes, I am a hypocrite as I (well, the then GF and I) had a close call once. Made me sit up and think about my actions, that's for sure.

But yeah, just go to another pharmacy, bitch!

I don't see how this is a question in this case. It's three women suing to make the pill available for public health. It would be different if it were one women suing because she's now pregnant and couldn't get the pill at the time.

Certain professions are held to standards for the safety of the public. This is in that grey area. Private hospitals can't turn away patients that don't pay or don't fit their moral code. It comes with the business. If you want to operate a pharmacy, be prepared to follow the set of regulations that goes with it. How about some personal responsibility on WalMart's side? They weren't ignorant to these rules when they started opening pharmacies on their premises.

I did something stupid and got all freaked that I got someone pregnant. If that same thing hasn't happened to you then the obvious and only conclusion is that you're not having enough boot knockin.

Or a Muslim refusing to fill a prescription for a blind person with a seeing eye dog?

Or a Christian refusing to fill a prescription until you pray with him?

I want to buy a pharmacy in a small town in middle America. I won't fill your prescription if you go to church. And I'll keep tabs. If you don't like it, drive to the next town, mother ****er...Oh, you'll die without your heart medicine? Boo hoo. Pray.

Bigger question, why would a woman who is not looking to get pregnant not be on a regular birth controll pill? I know once they come out with the male version I'll be first in line, condoms are great but they can fail so swallow a pill and wear a rubber and stop worrying so damn much. The lawsuit seems more like a P.R. issue than a serious legal action.

Actually, that's a much smaller question, and you can feel free to take it up with your wife, daughter or girlfriend. For the whole of the population, there are endless reasons why someone may not be on the pill, from chemical/hormonal, to underage girls afraid to ask for it, to girls being raped, to changing medications, to missing a pill, to the pill not working, and frankly none of them are your business. The pharmacy has a legal obligation to carry certain medications. This is one of them. If they don't like it, they can pick another ****ing business. There are lots of them. I'm sure there are plenty of potential competitors lining up to open a pharmacy next door as soon s walmart shuts theirs down.

Until recently the pill was unavailable here in Japan. When it was made available I asked my missus if she wanted to go on it. She was pretty adamant that she didn't want it so I left it at that. It's up to her. End of story. I neither wanted or expected her to give me a reason.

Well...they don't have an ethical problem with supplying old men with viagra...so they should at least carry the solution for the problem.

No you can sue them for failing to meet the standards to which they've agreed.

If there's a giant section of train track missing, and a train coming downthe tracks 100 miles away, do you wait for the train to hit that section or do you address the recognizable problem before any real damage is done?

Well once someone is on a train going 100mph, they don't have a lot of choice about where they are going.

A teenage skank waking up after getting gangbanged by the local high school hockey team on the other hand, can go to any pharmacy she wants. And although it has been established that she has an extremely feeble brain, even a moron of her magnitude should be able to discern that she can't buy something that isn't on the shelf.

It's the principle of the thing. Yeah, they might live in Boston, and yeah they might be able to go down the block to a CVS, but we don't make laws that have exceptions for large cities with multiple CVS stores.

Why not?

Shouldn't equality apply here. We standardize things across states and the country in order to make certain items and services obtainable for all. Medicine falls into this category. In the example of the person in the Bible Belt town, don't you think that it would be a good idea to make sure pharmacies carry things like birth control so that people can actually obtain it?
